These Terms of Use ("Terms") govern your use of our Swincar hire services (the "Services"). By hiring a Swincar from us, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By hiring a Swincar from us, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use our Services.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Services after the changes become effective will be considered acceptance of the new Terms.

3. Rental Eligibility

3.1 Age Requirement

You must be at least 16 years old to hire a Swincar from us. By using our Services, you represent and warrant that you meet this age requirement. Proof of age will be required.

3.2 Health and Fitness

You must be in good health and physically capable of operating a Swincar. You must not be under the influence of drugs or alcohol while operating the Swincar.

4. Rental Process

4.1 Booking

You may book a Swincar through our website email form, or by contacting our booking team. All bookings are subject to Swincar availability.

4.2 Payment

Full payment for the hire must be made at the time of booking. We accept all credit and debit cards. 

Invoicing and/or BAC; s payments are accepted for large groups or corporates. 

4.3 Deposit

A refundable deposit of 20% will be required at the time of booking for group bookings of 8 or more.

5. Use of Swincar

5.1 Authorized Riders

Only the individual(s) listed in the hire agreement are authorized to ride the Swincar.

5.2 Safety Gear

You agree to wear appropriate safety gear at all times while operating the quad bike, including but not limited to helmets, gloves, and eye protection.

5.3 Prohibited Uses

You agree not to:

• Use the Swincar for any illegal purpose or in violation of any local, national, or international law.
• Allow anyone other than the authorized rider(s) to operate the quad bike.
• Use the Swincar in a reckless or dangerous manner.
• Use the Swincar under the influence of alcohol, drugs, or any other substances that impair your ability to operate the vehicle safely.

6. Responsibilities

6.1 Swincar Condition

You agree to return the quad bike in the same condition it was provided, excluding normal wear and tear. You will be responsible for any damage, loss, or theft of the Swincar during the hire period.

7. Liability and Insurance

7.1 Liability

You are responsible for all damages and loss to the Swincar occurring during the hire period, regardless of fault.

7.2 Insurance

Insurance coverage is not provided with the hire. You may use your own insurance.

8. Termination

We reserve the right to terminate the hire agreement if you violate any of these Terms or if the Swincar is used in a manner that we deem inappropriate or unsafe.

9. Disclaimers and Limitation of Liability

9.1 Disclaimers

The Swincar is provided "as is" without warranties of any kind, either express or implied. SwincarUK Ltd disclaims all warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

9.2 Limitation of Liability

In no event will SwincarUK Ltd, its affiliates, directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Swincar or these Terms, whether based on warranty, contract, tort, or any other legal theory.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
